Plain-language summary: Access Control One is software that residential communities use to manage visitor access, packages, vehicles, maintenance billing, and fines. Your community association — not ACO — decides how the system is used, sets fees and fines, and receives your payments. By using the Platform you agree to these Terms.
1.Acceptance of these Terms
By creating an account, signing in, installing the Resident App, or otherwise using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Platform.
You must be at least 18 years old (or the age of legal majority in your jurisdiction) to create an account.
2.Definitions
- “Community” means the residential complex, homeowners’ association, condominium council, or property manager that has contracted with ACO to use the Platform.
- “Administrator” means a person authorized by a Community to configure and operate the Platform for that Community.
- “Resident” means a person who uses the Resident App under an account linked to a home or unit within a Community, activated with a registration code issued by that Community.
- “Services” means the features made available through the Platform, which may include visitor registration and access logs, pre-authorized visitor lists, package tracking, vehicle registration, home documents, community events and activities, security requests, accounting, maintenance billing, and fines management.
3.Role of ACO; role of your Community
ACO provides the Platform as a software service to Communities. Each Community controls its own instance of the Platform, including which modules are enabled, who is issued registration codes, the amounts and application of maintenance fees and fines, visitor access rules, and the retention of its records.
- Your residency relationship, and any fees, fines, rules, or disputes, are between you and your Community, not ACO.
- ACO does not verify, and is not responsible for, the accuracy of charges, fines, notices, or other content entered into the Platform by Communities, Administrators, guards, or Residents.
- Administrators and Communities are responsible for complying with the laws that apply to their management of resident and visitor data.
4.Accounts and registration
- Resident accounts are created with an email address, a password, and a registration code provided by your Community. You are responsible for keeping your credentials confidential and for all activity under your account.
- You agree to provide accurate information and to keep it up to date. Accounts are personal; do not share your account or use another person’s account.
- Your Community may suspend or revoke your access to its instance of the Platform (for example, when you move out). ACO may suspend or terminate accounts that violate these Terms or threaten the security of the Platform.
4.1 Biometric sign-in (Face ID / fingerprint)
The Resident App offers optional biometric sign-in using your device’s built-in authentication (e.g., Face ID, Touch ID, or Android biometrics, via the WebAuthn/passkey standard). Your biometric data is processed and stored only on your device by its operating system; it is never transmitted to or stored on ACO servers. Anyone whose biometrics are enrolled on your device may be able to access your account; you are responsible for controlling enrollment on your own device.
5.The Resident App (PWA)
- The Resident App may be used in a browser, installed to your home screen, or installed from the Apple App Store or Google Play. The same account and these same Terms apply in all cases.
- The App may request device permissions such as notifications (e.g., visitor-arrival alerts) or camera access. Permissions are optional and can be managed in your device settings; some features may not work without them.
- The App requires an internet connection for most functions. We may update the App automatically to maintain security and functionality.
6.Payments, maintenance fees, and fines
- Where a Community enables online payments, payments are processed by Stripe through the Community’s own Stripe account. ACO does not receive, hold, or transmit your funds and is not a party to the payment transaction.
- Card and bank details are collected and processed by Stripe, not by ACO, and are subject to Stripe’s own terms and privacy policy (stripe.com/legal).
- The amounts, due dates, late charges, and application of maintenance fees and fines are determined solely by your Community. Refunds, chargebacks, billing errors, and disputes about any charge or fine must be raised with your Community.
- Payment records shown in the Platform are informational; your Community’s official accounting records prevail in case of discrepancy.
7.Artificial-intelligence features
- Some features of the Platform may use third-party artificial-intelligence services (each Community may have its own AI integration) to process information — for example, to assist with data entry, summaries, or notifications.
- Content submitted to AI-assisted features may be processed by the third-party AI provider on behalf of the Platform. We do not permit these providers to use your content to train their public models except as disclosed in the Privacy Policy.
- AI output can be inaccurate or incomplete and is provided for convenience only. It is not legal, financial, or professional advice, and consequential decisions (such as issuing a fine or denying access) remain the responsibility of the Community and its Administrators.
8.Your content and visitor information
- You retain ownership of the information you submit (visitor names, vehicle details, documents, etc.). You grant ACO a non-exclusive license to host and process it solely to operate and improve the Platform.
- When you register a visitor or other third party, you confirm that you are authorized to provide their information for the purpose of access control at your Community.
- You agree not to submit content that is unlawful, false, defamatory, or infringing.
9.Acceptable use
You agree not to: (a) use the Platform for any unlawful purpose; (b) attempt to gain unauthorized access to accounts, data, or systems; (c) probe, scan, or test the vulnerability of the Platform without written authorization; (d) interfere with its operation, including by introducing malware or placing unreasonable load; (e) scrape or bulk-extract data; (f) reverse-engineer, copy, resell, or create derivative works of the Platform except as permitted by law; or (g) use the Platform to harass, stalk, or track any person.
10.Not an emergency or security-guarantee service
The Platform is a management tool. It does not guarantee the prevention of unauthorized access, theft, or any crime, and it is not an emergency service. In an emergency, call 911 or your local emergency number.
Access decisions are made by your Community and its personnel. Notifications (including visitor alerts) may be delayed or fail due to factors outside our control, such as device settings or network conditions.
11.Intellectual property
The Platform, including its software, design, logos, and content (excluding content submitted by Communities and Residents), is owned by ACO or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Platform for its intended purpose. The “Access Control One” name and dot-grid logo are trademarks of ACO.
12.Third-party services
The Platform relies on third-party services, including payment processing (Stripe), hosting and infrastructure providers, push-notification services, and AI providers. Their availability is outside our control, and their terms apply to their services. Links to third-party sites are provided for convenience; we are not responsible for their content.
13.Privacy
Our collection and use of personal information is described in the Privacy Policy. In summary: account and usage data are processed to operate the Platform; visitor, billing, and fine records are processed on behalf of your Community; payment card data goes directly to Stripe; and biometric sign-in data never leaves your device.
14.Disclaimers
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. ACO DOES NOT WARRANT THE ACCURACY OF RECORDS, CHARGES, OR CONTENT ENTERED BY COMMUNITIES, ADMINISTRATORS, GUARDS, OR RESIDENTS, NOR THE OUTPUT OF AI-ASSISTED FEATURES.
15.Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) ACO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL; (B) ACO WILL NOT BE LIABLE FOR DISPUTES BETWEEN YOU AND YOUR COMMUNITY, FOR ACCESS DECISIONS, OR FOR EVENTS OCCURRING AT ANY PROPERTY; AND (C) ACO’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE PLATFORM WILL NOT EXCEED THE GREATER OF (i) THE AMOUNTS YOU PAID ACO (NOT YOUR COMMUNITY) IN THE 12 MONTHS BEFORE THE CLAIM, OR (ii) FIFTY U.S. DOLLARS (US $50). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
16.Indemnification
You agree to indemnify and hold harmless ACO from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your content, or your misuse of the Platform.
17.Suspension and termination
You may stop using the Platform and delete the Resident App at any time; account deletion can be requested as described in the Privacy Policy. We may suspend or terminate access for breach of these Terms, security risk, legal requirement, or termination of the agreement between ACO and your Community. Sections that by their nature should survive (including 8, 11, and 14–19) survive termination.
18.Changes to the Platform or these Terms
We may modify the Platform or these Terms. For material changes we will give notice through the Platform or by email, and the updated Terms will apply from the stated effective date. Continued use after the effective date constitutes acceptance.
19.Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Puerto Rico, without regard to conflict-of-law rules. The courts located in San Juan, Puerto Rico will have exclusive jurisdiction, and you consent to their venue, except that either party may bring qualifying claims in small-claims court or seek injunctive relief for intellectual-property misuse in any competent court.
20.App-store terms (Apple and Google)
If you obtained the Resident App through the Apple App Store or Google Play, the following also applies:
- These Terms are between you and ACO only — not with Apple Inc. or Google LLC. Apple and Google are not responsible for the App or its content, and have no obligation to provide maintenance or support for it.
- In the event the App fails to conform to an applicable warranty, you may notify Apple and Apple will refund any purchase price paid for the App (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- Apple and Google are not responsible for addressing any claims relating to the App, including product-liability claims, legal-compliance claims, or consumer-protection claims, or any third-party claim that the App infringes intellectual-property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to the App and may enforce them against you.
- Your use of the App must also comply with the applicable app-store terms of service.
21.General
These Terms (with the Privacy Policy and any Community-specific notices) are the entire agreement between you and ACO regarding the Platform. If any provision is held unenforceable, the remainder remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. Notices to you may be given through the Platform or to your account email.
